Obtaining a Marriage License in Indiana

PLEASE NOTE: State and county marriage license requirements often change.
This information is for guidance only and should not be regarded as legal advice.
It is important that you verify all information with your local marriage license office before making any wedding or travel plans.

Application:

For many counties, you may begin the process online through the state website:
http://www.in.gov/judiciary/2605.htm.

Both the bride and groom will be required to visit the Clerk's Office in person to begin and/or complete the marriage license process.

Identification:

Typically, a valid Drivers license or State ID card showing your current address and date of birth will suffice.
Bring a certified copy of your birth certificate as well because some counties require it as a form of identification.

Age Requirements:

A certified copy of your birth certificate is required.
If you are 17 years old, you must apply for the license with both parents (or the person with legal custody).
The parents will be required to sign the consent portion of the application.
If you are 16 or 15 years old, you must petition the Circuit Court via a "Permission to Marry" form.
The cost for filing this petition is $124.00, even if the Judge refuses to allow the couple to marry.

Residency:

You do not need to be a resident of Indiana to apply for a license. Indiana residents are required to apply in their county of residence.

Previous Marriages:

We recommend taking a copy of your divorce decree(s) to apply as some counties require it.
Every county clerk will at least need to know how the marriages ended (death, divorce, annulment) and the month and year the marriages ended.

Waiting Period?:

No waiting period. The license is good for 60 days.

Fees:

$18-$20 for Indiana residents and $60 for all others. We recommend bringing cash as many counties do not accept checks or credit cards.

Blood Tests or Physicals?:

No blood tests, physicals or medical documents are required in Indiana to get married.

Proxy or Covenant Marriages:

Not authorized in Indiana.

Cousin Marriages in Indiana:

Marriage between first cousins is permitted if both individuals are at least sixty-five (65) years of age.

Common Law Marriages:

No. Indiana does recognize common law marriages, even if legalized by another state.

Same Sex Marriages:

Indiana currently does issue marriage licenses to same-sex couples.

Officiants:

Marriages may be performed by a member of the clergy (including a minister, priest, bishop, rabbi, and imam), a judge,
a magistrate, mayor, a clerk of the circuit court, or a clerk or clerk-treasurer of a city or town.
Please call the local courthouse to check on "justice of the peace" weddings as many counties no longer offer this service.
